The article clearly states that you have to opt in, explicitly (for Messages) or by deciding to use iCloud photo sync, so you *do* have a choice

I agree they’re not doing it now, but the problem, as @gruber points out, is the slippery slope once you start enabling content checks on a client device that’s supposed to do actual reliable E2E encryption
