Maybe I misunderstand? I know this very well. When a visa's over, the person is now deemed "illegal" but prosecution is in civil court only.

Arizona has been very bad. Joe Arpaio militarized police and border patrol. They sit lined up on I10 in SUVs - 3 each side stopping by race.

The other subset of Illegal Immigration is UNLAWFUL PRESENCE. This is when someone comes in legally stays longer - NOT A CRIME. Civil issue.
