No matter what we think of Donald Trump politically, he must be treated fairly by our justice system. Equal treatment before the law not only means that everyone is held accountable, but also that everyone is innocent until proven guilty. Trump has not been proven guilty of insurrection in a court of law, and a ruling based on nothing but that opinion is stepping onto a very slippery slope.

Lmao what? It's a constitutional provision which a higher court has made a judgement on. We'll see how it goes. Uncommon Marianne L.

Replying to @tsgrissom17
That's the point. They made a ruling on someone's guilt although that person had not been proven guilty in a court of law.

The 14th amendment does not use the term conviction. It only says, “engaged in insurrection.”
The writing is on the wall.
Where does it specify a conviction in the 14th Amendment Section 3? Every confederate was not convicted but were still unable to hold public office.

No, they didn’t. The language is ‘engaged in’, not ‘guilty of’.
They didn't make a ruling? What was that whole 2nd impeachment about? They both didn't go through, pretty sure that shows he didn't insight an insurrection. He repeated the same words other presidents and politicians have in the exact same spot. Why is he different?
Imagine if there was a provision making people that hit others in a car a consitutional violation. Say a candidate violates this on camera. A trial must occur to determine the legal outcome, but it is still an obvious violation that was recorded. It can be acted on.

Have people had to go to court to prove they're 36 years of age and natural born US citizens?
Do you know anything at all about the 14th Amendment or its history? It never required an arrest or conviction. All insurrectionists from the Civil War were banned from holding office, and none of them had to be arrested or put on trial first.
Marianne, The court made a simple finding of fact, a fact which we all saw take place and which Trump is publicly proud of. The 14th depends on facts, not convictions.
