No matter what we think of Donald Trump politically, he must be treated fairly by our justice system. Equal treatment before the law not only means that everyone is held accountable, but also that everyone is innocent until proven guilty. Trump has not been proven guilty of insurrection in a court of law, and a ruling based on nothing but that opinion is stepping onto a very slippery slope.

I'm a big fan of Marianne, and this is a stupid, stupid post. The 14th Am. is self-executing; it doesn't require a decision by a court. That was the basis for barring a former Confederate officer from being Senator in 1870.

He was found to have committed insurrection by the appellate and supreme courts of Colorado. He doesn’t need to be criminally charged or even convicted, the constitution applies simply when an officer of the U.S. “engaged in” insurrection. 14A vs 13A to show the difference.

I’m not sure I agree considering the “aid or comfort to” part of the clause and he definitely comforted people who were convicted but I will say it’s a very difficult topic. Made even more troublesome because it’s AT BEST a slim majority that thinks he would be disqualified

So you’re ignoring the Congressional hearings (which constitute findings of fact) & the hearing held by the lower court (which constitute legal findings of fact), and calling all that “opinion” while ignoring that the Clear text of the 14th does not require conviction? Why?
