No matter what we think of Donald Trump politically, he must be treated fairly by our justice system. Equal treatment before the law not only means that everyone is held accountable, but also that everyone is innocent until proven guilty. Trump has not been proven guilty of insurrection in a court of law, and a ruling based on nothing but that opinion is stepping onto a very slippery slope.

Might help to read the CO opinion. The CO election qualification statute doesn’t require a criminal conviction for insurrection to disqualify. The court determined that the facts submitted at trial supported a finding of insurrection using Civil War-era and modern definitions of the term “insurrection.” See the text of the decision around Par. 213 for court’s discussion on the term and its findings.
