No matter what we think of Donald Trump politically, he must be treated fairly by our justice system. Equal treatment before the law not only means that everyone is held accountable, but also that everyone is innocent until proven guilty. Trump has not been proven guilty of insurrection in a court of law, and a ruling based on nothing but that opinion is stepping onto a very slippery slope.

I personally think they should have relied on Trump's Public "comfort" he has been giving January 6th insurrectionists. In my mind, simply calling them "Patriots" and his remarks that he intends to pardon many of them constitutes comfort and aid which also disqualifies someone within the context of the 14th amendment. Don't have to prove that Donald Trump himself is an insurrectionist, but his support of their actions is more than enough to disqualify him.* *If the court ultimately rules that Donald Trump was a "Officer of the United States".
