So far regulation has been ineffective and essentially allows companies well connected to Congress to dictate regulations that destroys their competition and prevent any company from challenging them in the future.

Hypercapitalism isn't a thing. What you're upset about is a rigid capitalism where incentives are corrupted, preventing market forces from allocating funds to where they are desired.
