man died last year in a motel after FINALLY being released from San Quentin due to pandemic. It was explained that he had stolen a box of donuts and the theft of the box of donuts was the "third strike" that sent him to prison.

I am a lawyer. This happens regularly. In Florida (and many other states) the jury is not allowed to know the penalty during trial because it could affect their verdict, and the jury does not sentence them. It is utterly silly.
