Long before Justice Brett Kavanaugh considered "late arriving" votes "illegitimate," lawyer Brett Kavanaugh labored for their inclusion. If not for the votes Kavanaugh helped add to the totals in Florida on THANKSIVING weekend, Bush might have lost n 2000.

Take it from me: the only way to avoid Bush v Gore II is to win by enough votes that 2020 never gets to the Supreme Court. Don't let the Court have this power: all of us, at the ballot box, need to decide this election.
Holy shit—Brett Kavanaugh just endorsed Rehnquist's concurrence in Bush v. Gore, which was too extreme for Kennedy or O'Connor. This is a red alert. I can't believe he put it in a footnote. This is terrifying. assets.documentcloud.org/doc…

Yeah, it is big enough, but a circuit with just one state seems weird. Maybe stick to my original California + Hawaii?

Or, even better, California + Hawaii + Nevada in the 9th Circuit, give Arizona to the 10th Circuit, take Wyoming for the new Seattle-based circuit, and get all of Yellowstone National Park at least in one appellate circuit (although still multiple districts, drat!).
Maybe split the 9th Circuit at the same time as abolishing the Federal Circuit to maintain the principle? Maybe California+Hawaii (San Francisco) vs. all the rest (Seattle)? Or should Arizona and maybe Nevada stick with California?

So expand SCOTUS to 13 (counting the 11 numbered circuits, the DC Circuit, and the Federal Circuit)... and then abolish the Federal Circuit?
Pelosi being pretty explicit about judicial reform is on the table on Hayes right now, observing the original understanding that the number of Supreme Court justices should track the number or circuits

Once Barrett is confirmed a MAJORITY of the Supreme Court will be 5 GOP justices confirmed by senates where the GOP majorities were elected with fewer votes than Dems across all 100 seats. 3 of them by a president who lost the popular vote & 2 by one who lost it in his first term
