Uncomfortable question : why did it require a citizen to bring this case to Court? The facts were known to all the EU DPA's, weren't they? Might be time for them to act a little bit more decisively in order to restore their credibility.

More seriously, the most likely answer might be : "if we are serious about regulation, US companies are going to leave the EU market"... Sure, US corps are known to give up on their most profitable markets :-)
