They didn't know they had them and to be a crime you would have to prove intent. They can't, which why Pence wasn't charged. Instead they both did what you're supposed to do by contacting the NARA to return them. After that they consented to further searches by the FBI to ensure all were found and returned. Trump did the exact opposite of all of this. He knowingly took, hid, ignored a federal subpoena, and obstructed an investigation to get them back. All he had to do was give them back and wouldn't. His problem and now he can find out.
