Hi Tony, please make sure to reach out to the store where you purchased the game from if you received a damaged copy, and you may be able to receive a refund there. ^FF
Unfortunately the Switch version goes entirely through Nintendo, or through the retailers selling the cartridges. I would recommend reaching out to one of those two to see if anything can be done in this case. ^NS
