Some jobs do not require oaths, others do. Each of these Senators could have a job that does not required swearing to uphold our Constitution. But, they did become Senators, and they did so swear.  So, it’s convict, or be an oath-breaker.

With the senate gone, Trump would have had the absolute authority, right? So he had an incentive to not protect the Capitol! This is so apparent in the ongoing trial.
