Presidential eligibility and the 14th Amendment!
If you are born on US soil to parents with foreign allegiance, in other words, non U.S. citizens, you erroneously fall under the 14th amendment guidelines and are not eligible to be POTUS.
It seems people believe that the Wong Kim Ark decision of 1898 made people born on US soil, to foreign citizen parents, a US natural born citizen. Wong was found to be a CITIZEN and only a CITIZEN exactly as the 14th states nothing about him being a natural born citizen.
Those people are mistaken, and their assumption, that if you are simply born on US soil you are a natural born citizen, eligible to be president is about as messed up and misconstrued of an understanding of the 14th amendment as it gets..
The 14th states: "All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are CITIZENS of the United States and the State wherein they reside."
Read on and tell me how
@KamalaHarris,
@NikkiHaley, and
@VivekRamaswamy can be considered natural born citizens since they are born to non U.S. citizen parents.
Article II Section I Clause 5: "No person except a natural born Citizen, or a Citizen of the United States, at the time of the Adoption of this Constitution, shall be eligible to the Office of President;
So the only time a citizen could ever be president was if you were born in the 18th century.
So I ask you, based on the Article II Section I Clause 5 Presidential Requirements to the constitution that states that only a citizen at the time of the signing of the constitution should be president where were these new found natural born citizens going to come from?
The answer is very simple, these new natural born American US citizens will be the children of the citizens that signed the the constitution.
The founding fathers wanted so much for the creation of this NEW NATION to survive all that it would face over time. They derived their concept of the natural born citizen clause from the writings of Vattel 212 : The citizens are the members of the civil society; bound to this society by certain duties, and subject to its authority, they equally participate in its advantages. The natives, or natural-born citizens, are those born in the country, of parents who are its citizens. As the society cannot exist and perpetuate itself otherwise than by the children of the citizens, those children naturally follow the condition of their fathers, and succeed to all their rights.
Born on US soil to two US citizen parents, it can be no other way if we are to preserve this NEW NATION from the throngs that want to tear it down!
